1. Who we are

Live From Rest is operated by Stephen Smith. In this notice, “Live From Rest”, “we”, “us” and “our” refer to the person or business responsible for deciding how your personal information is used.

2. What this notice covers

This notice explains how we collect and use personal information when you:

  • visit livefromrest.com;

  • create or use a Live From Rest app account;

  • register for or attend a webinar;

  • ask to receive emails from us;

  • contact us or request support; or

  • exercise your data-protection rights.

The Live From Rest app is provided completely free of charge. We do not require or collect payment-card information to give you access to the app.

If you separately purchase another Live From Rest product or service, any payment will be handled by the payment provider identified at checkout. Live From Rest does not normally receive your complete card details.

3. Information we collect

Depending on how you interact with Live From Rest, we may collect:

  • your name and email address;

  • your account and login information;

  • records of content you access and your progress within the app;

  • webinar registration information, including the webinar, registration date, attendance status and interactions such as questions or survey responses;

  • your email preferences and evidence of any consent you give;

  • records showing whether emails were delivered, opened or selected;

  • messages, support requests and other correspondence;

  • technical information such as your IP address, browser, device type and website activity;

  • cookie and analytics information, where you have permitted non-essential cookies;

  • limited transaction information if you separately purchase a product or service; and

  • records relating to privacy requests, complaints or actions taken in response.

We do not ask you to provide medical diagnoses or other health information through ordinary registration or contact forms. We do not use your app activity or webinar registration to diagnose you or infer that you have a particular mental-health condition.

If a particular feature needs to collect sensitive information, we will explain this separately before collecting it and obtain explicit consent where required.

4. How and why we use your information

Providing the free app

We use your account information to:

  • create and maintain your account;

  • provide access to the app and its content;

  • remember your progress;

  • provide technical support;

  • communicate important information about the service; and

  • keep the app and its users secure.

Our lawful basis is that the processing is necessary to provide the service you requested or, where appropriate, our legitimate interest in operating, protecting and improving the free service.

Webinar registration and administration

When you register for a webinar, we use your name, email address and registration information to:

  • register you for the webinar;

  • send confirmation and joining instructions;

  • send reasonable reminders or schedule changes;

  • deliver the webinar and provide technical support; and

  • send replay details where a replay was offered as part of registration.

These are webinar-administration communications. Registering for a webinar does not, by itself, mean that you have agreed to receive ongoing marketing.

Our lawful basis is providing the webinar you requested and our legitimate interest in administering it effectively.

Optional webinar follow-up and marketing

We may invite you to make a separate, optional choice to receive follow-up or marketing emails.

These emails may contain:

  • information relating to the webinar topic;

  • related Live From Rest resources;

  • information about the free Live From Rest app;

  • invitations to future webinars; and

  • information about other Live From Rest services.

Where we rely on consent, you will be asked to take a positive action, such as submitting a separate Kajabi form. You do not have to agree to marketing to register for a webinar or use the free app.

You can withdraw your consent at any time by using the unsubscribe link in an email or contacting us. Withdrawing consent does not affect processing that took place before it was withdrawn.

Responding to enquiries

We use information contained in messages to answer questions, provide support and deal with complaints or privacy requests.

Our lawful basis is our legitimate interest in communicating with people who contact us and, where applicable, compliance with our legal obligations.

Website operation, security and analytics

We use essential technical information to:

  • operate the website and app;

  • maintain security;

  • prevent or investigate misuse;

  • diagnose technical problems; and

  • understand whether the services are functioning correctly.

With your consent, we may use non-essential cookies or analytics to understand how people use the website and app. You can manage your choices through the website’s cookie controls.

Legal and compliance purposes

We may use or retain information where necessary to:

  • comply with a legal obligation;

  • respond to a lawful request;

  • establish, exercise or defend legal claims;

  • prevent fraud or misuse; or

  • demonstrate how we handled a privacy request, complaint, consent or marketing objection.

5. Service providers

We use service providers to operate Live From Rest. Depending on how you interact with us, these may include:

  • Kajabi, which hosts livefromrest.com, provides account and app functionality and manages email communications;

  • EasyWebinar, which manages webinar registration, delivery and attendance information;

  • Zapier, where used, which transfers selected registration information between EasyWebinar and Kajabi;

  • payment providers, where someone separately purchases a paid product or service;

  • providers of website hosting, security, analytics and technical support; and

  • professional advisers where reasonably necessary.

For example, the information needed to administer a webinar may be transferred from EasyWebinar to Kajabi through Zapier. This does not mean that the person has agreed to marketing. Unless they make a separate marketing choice, their information must only be used for webinar administration and other purposes described at registration.

These organisations may process information on our behalf under their contractual terms and data-protection obligations.

We do not sell or rent your personal information.

We may disclose information where required by law, where necessary to protect someone’s vital interests, or where reasonably necessary to establish or defend legal rights.

6. International processing

Kajabi, EasyWebinar, Zapier and some of their service providers operate internationally. Your information may therefore be processed in the United States or other countries outside the United Kingdom.

Where a restricted international transfer takes place, we use the safeguards required by UK data-protection law. These may include an adequacy regulation, the UK International Data Transfer Agreement, or the UK Addendum to approved Standard Contractual Clauses.

7. How long we keep information

We retain personal information for as long as it is reasonably necessary for the purpose for which it was collected. When deciding how long information should be kept, we consider:

  • whether you continue to have an account or use our services;

  • whether the information is needed to provide something you requested;

  • whether you remain subscribed to email communications;

  • whether it is needed to maintain an accurate record of your consent or marketing preferences;

  • whether it is needed to answer an enquiry, resolve a complaint or demonstrate how a privacy request was handled;

  • the sensitivity of the information and the potential consequences of retaining it;

  • the retention arrangements of the service providers we use; and

  • any legal, regulatory, accounting or dispute-related reason for keeping it.

In particular:

  • account and app information may be retained while your account remains open or while it is needed to provide the service;

  • webinar information may be retained while needed to administer the webinar, provide the promised replay, answer related enquiries or manage your communication preferences;

  • marketing information may be retained while you remain subscribed;

  • evidence of consent may be retained while we rely on that consent and afterwards where reasonably necessary to demonstrate compliance;

  • if you unsubscribe or object to marketing, we may retain a minimal record of that preference so that you are not inadvertently contacted again;

  • correspondence and records concerning complaints or privacy requests may be retained where necessary to demonstrate how the matter was handled; and

  • information may remain temporarily within restricted backups until those backups are replaced through the relevant provider’s normal cycle.

We periodically review the personal information we hold. When identifiable information is no longer reasonably required, we will delete it or anonymise it so that it can no longer be associated with an individual.

8. Email choices and your right to object

Every marketing email will provide a way to unsubscribe.

You have an absolute right to object to the use of your personal information for direct marketing. If you object or unsubscribe, we will stop using your information for that purpose.

Unsubscribing from marketing does not prevent us from sending strictly necessary messages about an account, webinar, transaction or request you have made.

9. Your data-protection rights

Depending on the circumstances, you may have the right to:

  • ask for a copy of your personal information;

  • ask us to correct inaccurate or incomplete information;

  • ask us to delete your information;

  • ask us to restrict how information is used;

  • object to processing based on legitimate interests;

  • receive certain information in a portable format;

  • withdraw consent at any time; and

  • complain about how your information has been handled.

These rights are not all absolute, and an exemption may sometimes apply. We will explain our decision if we cannot fully comply with a request.

10. Automated decisions

We do not use personal information to make decisions about you based solely on automated processing that produce legal or similarly significant effects.

Automations may be used to:

  • deliver requested content;

  • transfer webinar registration information between service providers;

  • send webinar-administration communications; or

  • place you into an email sequence where you have made the required marketing choice.

11. Security

We use reasonable organisational and technical measures to protect personal information against loss, misuse, alteration and unauthorised access.

No online service can guarantee complete security. Please use a strong password and contact us if you believe your account or information may have been compromised.

12. Third-party websites

Our website, app or emails may link to websites operated by other organisations. Those organisations are responsible for their own privacy practices, and you should read their privacy notices before providing information to them.

13. Changes to this notice

We may update this notice when our services, providers or legal obligations change. The latest version will be published on livefromrest.com with a revised “last updated” date.

If a change materially affects how we use information already collected, we will provide additional notice where required.
